    The right to assess is a defining element of all Community Associations. Without the right to assess, an Association is a Civic Club not a Community Association. The Declarations of Covenants, Conditions and Restrictions (“CC&Rs”) of all Community Associations contain provisions authorizing the Association to levy and collect assessments and imposes an obligation on Owners to pay assessments. The language in individual CC&Rs may vary, but the provision is consistent in its intent – to provide the Association with the necessary funds to fulfill its obligations.
